General Terms and Conditions of Sale §1 Validity These general terms and conditions of sale in the current version at the time of ordering apply to contracts between Unternehmensgruppe Fürst von Hohenzollern Schloss Sigmaringen Karl Anton Platz 8 D – 72488 Sigmaringen Germany

The Unternehmensgruppe Fürst von Hohenzollern recognises deviant conditions only when these have been agreed upon in written form.These conditions of sale are valid for all future business with the customer. § 2 Completion of Contract The contract between the Buyer and the Unternehmensgruppe Fürst von Hohenzollern comes into being only after the customer places his order and this has been accepted and confirmed in writing (per e-mail or fax) by www.hohenzollern.com. § 3 Prices and Terms of Payment All prices entail the legal VAT. The valid prices are the prices quoted at the date of ordering. Payment within 7 days of ordering by bank transfer order or check without deduction.COD parcels. Provided that no other conditions have been agreed upon, our prices exclude dispatch and packaging. Costs for dispatch and packaging will be charged separately. The charges are on our price list that is order form.Withholding due payment because of charges for disputable counterclaims is inadmissible, as far as these counterclaims have not come into force. Special agreements shall be made in writing. When a new price list is published the other becomes invalid. § 4 Packaging Wine and sparkling wine are delivered in 750 ml bottles in disposable boxes for six or in the necessary packaging. § 5 Vintage Years for Wine and Sparkling Wine We are authorised to send you a new vintage year after the previous one has been used up, provided that the quality is not inferior and we have not otherwise been instructed by you. § 6 Dispatch Costs Cargo costs and dispatch packaging will be charged to prime costs. See “prices and dispatch”.We will deliver goods worth more than 100 .00 Euro, for wines and spirits from our Hohenzollern line more than 500.00 Euro gross value, without further costs to a given address in Germany. We charge a delivery flat rate of 7.40 Euro for orders worth up to 100.00 Euro within Germany. For deliveries outside of Germany please ask for further details. § 7 Delivery If not otherwise agreed upon, delivery will take place from the storehouse to an address specified by the Buyer. Once the goods have been given over to the Buyer, the risk passes to the Buyer.This is also valid for part deliveries. The delivery time shall not be of essence unless the delivery date has been promised as an exception. This is not valid for contracts with Businesses. Wine and sparkling wine will be delivered from the winery unless otherwise agreed upon. Risk of frost or heat release us from keeping to delivery times and dates until the onset of suitable weather. Delivery dates are always approximate only. § 8 Transportation Damage / Defect Compensation will be made only for goods in the original packaging. The customer is obliged to examine the goods immediately for signs of damage and obvious defects. Defects and transportation damages must be reported within 8 days after receipt of the goods. Crystallised crème of tartar is a natural component of the wine/ sparkling wine and not a reason for complaint. § 9 Liability The Unternehmensgruppe Fürst von Hohenzollern rules out any liability for products. The manufacturer has sole responsibility for the product liability. § 10 Right of Cancellation The customer can retract his contract within two weeks in written form (e.g. letter, fax ,e – mail) without giving any reason or by returning the goods. The time allowed for the cancellation begins at the earliest with receipt of these instructions. To keep within the time allowed please send the cancellation or the goods back in good time. The cancellation is to be sent to Unternehmensgruppe Fürst von Hohenzollern, Karl- Anton- Platz 8, 72488 Sigmaringen. In the case of an effective cancellation any payment/ services rendered on both sides must be reimbursed. If you cannot return services rendered either fully or in part or in bad condition, then you must pay compensation. You can avoid paying compensation if you refrain from using the goods and do everything in your power to keep its value. Goods suitable for dispatch can be returned at our costs and at our risk. Goods not suitable for dispatch will be picked up at your premises. § 11 Retention of Title The goods remain our property until full payment is made. § 12 Place of Performance and Jurisdiction Place of performance and place of jurisdiction are Sigmaringen. Our sales and delivery conditions are a fundamental component of every contract made with us.
